1. What this is about
waumate is a platform on which dog owners find people nearby who walk their dog, look after it during the day or take it in overnight (sitters). The provider is Maximilian Jeschek, Bürgerstraße 30, 01127 Dresden, hereinafter “we”. All contact details are in the imprint (legal notice).
These terms of use govern how you may use waumate. By signing up you agree to them. Use is free of charge.

2. What waumate is and what it is not
waumate establishes the contact: sitters describe what they offer, dog owners search, the two write to each other in the chat, and owners can review sitters. Whether care takes place, and on what terms, is agreed solely between yourselves. We do not become a party to the contract, do not process payments and do not accept bookings. Prices in a sitter's listing are a guide.
We check neither the identity of users nor the information they give, for example about experience, qualifications, insurance or the animal. Such information is marked as the user's own statements. Get to know each other before you agree on care, and meet beforehand with the dog.
3. Account
You only get an account if you are at least 18 years old. You need an email address that belongs to you, and you confirm it via the link we send you. Until then you can use waumate only to a limited extent. We delete an account whose address has not been confirmed after 7 days.
Each person has one account. Do not pass yourself off as someone else, keep your password secret and do not hand your account over to anyone. If you suspect that someone else has access, change your password and write to us.
4. Sitters' listings
As a sitter you are responsible for your listing yourself: the details must be correct and up to date. If you publish your listing, everyone sees in the search and on the public town pages, which search engines can also pick up, your first name, your profile picture, town and district, your first photo, the headline, your services and prices, the days of the week on which you have time, and the average of your reviews. Everything else is visible to signed-in members with a confirmed email address, and your street and house number to no one. You can pause your listing at any time.
You yourself take care of everything the law requires for your activity, for example the permit under § 11 Tierschutzgesetz (German Animal Welfare Act) if you look after animals on a commercial basis, a business registration, insurance and paying tax on your income.
5. Dog owners
As a dog owner you tell the sitter honestly what they need to know about your dog, above all about its health, behaviour and how well it gets along with others. As its keeper you remain responsible for your dog. We strongly recommend animal keeper's liability insurance.
6. Content and conduct
You yourself are responsible for everything you post or write: profile, photos, pet profiles, messages and reviews. Post only content to which you hold the necessary rights, and photos of other people only with their consent.
Not permitted are unlawful content, insults, threats and harassment, attempted fraud and statements that deceive others, spam and advertising for anything other than the care you offer, the sale or placement of animals, collecting the data of other users, circumventing a suspension and anything that interferes with the technology of the platform, for example automated requests.
You can review a sitter only once you have written to each other in the chat. Review only your own experiences, objectively and truthfully. Not permitted are reviews in exchange for something in return, on behalf of others or with the aim of making your own listing look better. You can change or delete your review at any time.
So that waumate works, you grant us the non-exclusive right, free of charge, to store your content, to adapt it technically (for example to reduce the size of photos) and to show it to the people for whom it is intended. The right ends when you delete the content or your account.
7. Reporting, blocking and moderation
In every chat you can report the conversation or block the person. Anything else that you consider unlawful or against the rules, for example a profile, a photo or a review, you report by email to kontakt@waumate.com. This is also possible without an account. Tell us where the content is and why you are reporting it.
Reports are reviewed by people. We do not use automatic filters or programs that decide on content. If content or an account violates these terms or the law, we can, depending on the severity, remove content (reviews, photos, profile picture, display name), pause a sitter listing, suspend the account for 1, 7 or 30 days or indefinitely, or delete it. In doing so we take into account how serious the violation is and whether it is repeated.
We inform you of such a decision and the reasons for it by email. If you think it is wrong, write to us at kontakt@waumate.com; we then review it again. Anyone who has reported something is told by us how we decided.
8. Order of the search results
The search shows published listings within the chosen radius. You choose the sorting yourself: by distance (default), by rating or, if you have chosen a service, by price. Sorting by rating takes into account the number of reviews as well as the average; listings without a review come last there. The town pages show the listings of a town and its surrounding area, sorted by rating. There are no paid or preferential placements.
9. Availability and changes to the service
We operate waumate with care but are not obliged to provide uninterrupted availability. We may change, extend or discontinue features as long as the core of the service remains usable for you, and may discontinue the service entirely with 30 days' notice.
10. Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the Produkthaftungsgesetz (German Product Liability Act). If we breach, through slight negligence, an essential obligation on whose fulfilment you may rely, our liability is limited to the damage that is typically to be expected with a service like this one. Otherwise our liability is excluded.
We are not a party to the agreements between users. For the care itself, for damage between users and for the accuracy of their information we are therefore answerable only in so far as we ourselves are responsible for a breach of obligation under the preceding paragraph.
11. Term and termination
You can delete your account in the settings at any time. Before that you can download your data there. What happens to your data on deletion is set out in the privacy policy.
We can terminate your account by email with 30 days' notice, and in the case of serious or repeated violations also without notice. If you do not sign in for two years, we delete your account; 30 days beforehand we remind you by email.
12. Changes to these terms
We can change these terms if the service or the legal situation changes. We notify you of changes by email at least 30 days before they take effect. If something material changes to your disadvantage, the new version applies to you only once you agree to it. If you do not agree, we can terminate your account as of the time the changes take effect.
13. Final provisions
German law applies. If you are a consumer and live in another state of the European Union, the mandatory consumer protection provisions of that state remain applicable.
We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
